PHGIII Annual Meeting Report

 The PHGIII Annual Meeting was held October 13 at Evangel World Prayer Center.
 
Attendance was 18 residents, six Board members and there were 21 absentee ballots, representing 45 of the 64 PHGIII homes.
 
A special thanks to Evangel, the meeting room was one of the finest and most comfortable we have used, and was provided to us on a complimentary basis.
 
Board Election
 
Five new Board members were elected to the 7-member Board beginning January 1, 2023.

Bryan Messenger
 
In edition, two current Board members were reelected.  They are:

Special PHGIII Board Letter Re: Water Leak

PHGIII Residents:
 
Some of you may be aware that we had a large water leak that went undetected for some time.  This leak was not at anyone’s residence, but at the very end of Kingsmill Drive, where the water flowed into the association-owned common ground.  As soon as the leak was detected, immediate action was taken to have this repaired.  This was done without having to have any portion of Kingsmill Drive compromised.  
 
Due to this leak, our water bill has doubled for this billing cycle.  The HOA will talk to the Water Company to see if they will grant us an exemption on any of this, but in the meantime the HOA is obligated to pay.
 
Our next billing will be sent out late June or early July.  Residents will receive their normal invoices based on their amount of water used, plus drainage, trash and dues.  Sometime after this billing, a second invoice will be sent to each resident to cover the cost associated with the leak.  Everyone will be billed the same amount.  At this time, we are estimating that it will be a little over $100.00 per household.
 
We know this is not welcome news, but we are committed to keeping this fair and equitable to all residents.  Our Patio Homes will have problems from time to time due to aging infrastructure.  We will just have to deal with them as they present themselves, and try to be pro-active with maintaining our homes and grounds as much as possible.  We ask all residents to please speak up if they notice a problem, especially pooling water.  The longer something like this goes on, the more we all pay.

Acuity Insurance Company Sets PHGIII Requirements for Master Insurance Policy

Acuity, the insurance company which holds the association’s Master Insurance policy, recently did a walk through and assessment of our PHGIII patio homes.
They had only TWO requirements they would like to see implemented by all residents.
 
1. All barbecue cooking needs to take place a minimum of 10 feet from the home structure.
You can store your barbecues against the house, but for actual cooking they need to be 10 feet from the home.
 
2. Patio homes should have a limit of size of 40 pounds or less for all dogs.  This is also a Jefferson county regulation.

Appeals Court Backs Glenmary HOA

A decision was rendered by the Kentucky Court of Appeals on Case#: 2018-CA-00547.pdf on Friday 4/3/20 wherein the Appellant "Par Golf LLC" vs Appellee "Glenmary Homeowner's Association, INC., ET AL"  the decision of Circuit Court Judge Willett from 3/1/18 was affirmed.
 
A copy of this decision will be posted on the HOA Website for all to review. This decision is pivotal to the future of the Glenmary community and any future use of the golf course property. The Judge Willett decision orders reversal of the appproval of the three building lots on the golf property.
 
This ruling essentially upholds the Glenmary governing documents and land rights which prevents any future development of the golf property and should be considered a major win for all lot owners in Glenmary.

Fire at PHGIII Residence

A fire was reported in a PHGIII patio home in May.
 
An alert homeowner heard the smoke detector, smelled smoke and called 911.
 
No one was home at the time of the fire, and telephone numbers for the owners were out of date.
 
As a result, the fire department had to use axes to open the front door to gain access.
 
The fire was contained to a wall in the garage, but was burning inside the wall and could have been a significant fire if not for the alert neighbor.
 
It is the first fire in PHGIII’s history.

In addition, make sure your neighbors have a key or the code to your garage door opener.
 
And make sure you have the latest working cell or phone numbers for all of your neighbors.

Important Message From Your President…
 
As many of you know and for those of you who do not, many of our residents have encountered a severe water leak under their foundation. 
 
Even though we have detected these leaks and each resident  has gotten their leak repaired, the time between readings and detection is a 2 month period in which we are losing water and our drainage cost from the Louisville Water Company are going up.
 
 
 
Your board is making a request from each resident, we would like for you to begin reading your digital reader next to your garage door once a week and keep a running log of each reading.
 
If you see a discrepancy from one week to another, please contact Bill Geier (502-797-3332). This will help to catch the leak early, get the repair done and reduce our drainage cost from the water company.
 
 
PHGIII Portected By Erthquake Insurance

At the October Annual meeting, the issue was raised whether or not the master insurance policy of PHGIII protected homeowners against an earthquake.  Ken Mattingly has meet with our insurance representative, and confirmed that indeed the master policy has a declaration protecting all structures against earthquake damage.  However, you should check with your own insurer to make sure your homeowners coverage protects you for any personal losses as a result of an earthquake. Because one of the largest earthquakes ever recorded occurred along the New Madrid Fault Line, it is reassuring to know we are protected in the event of a major eatherquake.
PHG III Selects River City Bank

Yard Waste Pickup

There will be 3 more yard waste pickups before the end of the year.  They are scheduled the first Tuesday in October, November and December.  Please have your waste approved paper bags outside by 6:30 am.
Judge Willet Rules for GHA

On 3/1/18 Jefferson County Circuit Court Division One Judge Barry Willet has rendered a 34 page order in favor of the Glenmary Homeowners Association (Plantiffs) vs Par Golf LLC and Louisville Metro Planning Commission and Bryan, LLC (Defendants) in Case #'s 14CI-0844 and 14CI-2143. These cases centered around the issue wherein the actions to create 3 building lots which were subject to specification restrictions. 
The order reads as follows:
1. The Planning Commission's decisions to approve application 19173, 19174, and 19219 at its March 20, 2014 meeting are Reversed and Set Aside.
2. Within sixty (60) days of this Order, the Planning Commission shall take all necessary and required actions to insure that the amended plats resulting from their vote on applications 19173, 19174 and 19219 are voided and held for naught.
3. Applications 19173, 19174 and 19219 are hereby Remanded to Planning Commission for any further proceedings consistent with this Opinion and LDC 7.1.90 and 7.1.91.
 
This order is very significant to the future of Glenmary and should be considered as piviotal in terms of any future development of the golf property.
